NOTICE OF AGREEMENT AND CONTRACT
BETWEEN
___________________________, a corporation, doing business as
___________________________, a restaurant
and
Charles G. Hill, an individual

KNOW ALL YE BY THESE PRESENTS, THAT:
On ______________________ (date), Charles G. Hill, an individual,
party of the first part, hereinafter known as "Diner", did enter
the premises of __________________, a restaurant, party of the
second part, hereinafter known as "Restaurant", and did request
that he be served one or more of the following:
___________ Eggs, over easy ___________ Sushi
___________ Eggs, sunny side up ___________ Vichyssoise
___________ Steak tartare ___________ Other (specify)
Diner and Restaurant stipulate that the preparation of such items
may be contrary to the wishes of the Food and Drug Administration.
By this Agreement and Contract, Diner and Restaurant mutually and
severally agree that Diner shall indemnify and hold harmless
Restaurant for any and all damages, which may include any or all of
the following:
Salmonella
Acid reflux
Diarrhea
Halitosis
or any other conditions, which may result from the preparation of
the aforementioned items at the request of Diner. Further, Diner
and Restaurant agree that because of crowded conditions prevailing
on Restaurant's premises, should Diner be served said items in
Restaurant's smoking section, Diner reserves the right to remain
silent.
This Agreement and Contract supersedes any previous agreement that
may exist between Diner and Restaurant, and is not subject to
review by the Department of Health and Human Services, of which the
Food and Drug Administration is a part.
